A district court judge dismisses a lawsuit filed by a Coffeyville city commissioner against the City.
The case was brought by Commissioner William Kendall, who sought to block the City’s planned $600,000 loan commitment to the Friends of the Charlesworth Natatorium LLC, the group supporting improvements to the Field Kindley High School indoor pool roof.
Court records show the City argued the lawsuit was premature, stating that while a letter of commitment had been approved in November, no funds had been issued and no finalized loan agreement had been executed at the time the complaint was filed. The judge dismissed the petition without prejudice, which allows it to be refiled. The City was represented by City Counselor Paul Kritz, while Kendall represented himself.
