A 47-year-old Garfield, Arkansas, man is convicted of leaving the scene of an accident involving death and DWI in a crash that killed a 14-year-old boy.
A jury handed down the verdict for Gregory Payne yesterday. Payne was originally charged with negligent homicide in the crash that killed Gavin Bivens as he was riding his motorbike along a roadway on July 27, 2024. That charge was dropped for an undisclosed reason as Payne's trial began on Monday. Witnesses testified that Payne struck Bivens head-on. The boy was airlifted to a hospital but later died from his injuries. Witnesses also told the jury that Payne exhibited a strong odor of intoxicants and glassy eyes following the accident. Payne had been convicted of five DWIs since 2004.
He will be sentenced in a Benton County courtroom today.
