The legal battles following a police raid on a small town Kansas newspaper continue to make their way through the system.
The former Vice Mayor and Councilwoman from Marion, Kansas, Ruth Herbel has filed a federal lawsuit against city officials, claiming a violation of her constitutional rights in August 2023. Herbel's attorneys from the Institute of Justice or I-J say the raid on her home violated her First Amendment right to free speech and her Fourth Amendment right to be secure in her home. I-J says police were able to raid her home with what they call a bogus warrant from a friendly judge.
Herbel seeks damages to compensate both her and her husband from harm they suffered as a result of the raid.
