Labette County Commissioner Brian Kinzie is challenging the recall petition that is calling for his removal from office. The request was filed Monday against County Clerk Gena Landis. Landis is named because of her duties that include receiving a recall petition and declaring the petition signatures sufficient to proceed to a recall election.
Kinzie's petition wants a judge to review the recall petition to determine if the process followed and completed by Landis was legally sufficient under the law. Kenzie claims that Landis did not follow the proper procedure for the recall petition.
A recall committee filed the petition in June seeking the ability to collect signatures for Kinzie’s recall. The recall committee turned in the petition in late August and Landis and her staff completed the review of signatures in September. The special election has been set for December 7th.
