Marion Newspaper Continues Legal Battle With City

The legal battle between the newspaper The Marion County Record and the City of Marion are heating up once again.

Eric Meyer, owner of the paper, and other reporters for The Marion County Record are asking the city for text messages between city staff and city council members during the time that the small town paper was raided by local police on August 11th of this year. The raids led to the resignation of Marion Police Chief Gideon Cody on September 28th .

Meyer says the newspaper is looking for what officials may have said to Cody and encouraged him to do. An attorney for the city of Marion has denied the request because the messages in question are on the private phones of city officials, stating that obtaining the messages from personal property would place an unreasonable burden on the city and the city is not obligated to produce the records.

Meyer says he thinks there is something in the messages and is considering legal action to obtain them.
